How to Pursue Compensation for Repetitive Strain Injuries at Work

Many workers are unaware that they can pursue compensation for repetitive strain injuries (RSIs) they suffer at work. RSIs are a type of injury that occur when the muscles, tendons, or nerves in the body are strained from repetitive motions. If you have suffered an RSI at work, you may be entitled to workers' compensation benefits. In this blog post, we will discuss how to pursue compensation for RSIs suffered at work.

Determine if You Have a Valid Claim



The first step in pursuing a claim for an RSI is to determine whether or not you have a valid claim. To do this, you will need to consider the following factors:

- The duration of your symptoms
- The severity of your symptoms
- Whether or not your job duties require repetitive motions
- Whether or not your employer was aware of the risk of RSIs and took steps to prevent them.

If you can answer 'yes' to all of the above factors, then you likely have a valid claim for workers' compensation benefits.

See a Doctor



It is important to see a doctor as soon as possible after suffering an RSI at work. This is because some RSIs can worsen over time if they are not treated properly. Seeing a doctor will also provide you with documentation of your injury, which will be important when pursuing a workers' compensation claim.

Your doctor will likely recommend one or more of the following treatments for your RSI: rest, ice, heat, physical therapy, and/or surgery.



Gather Documentation



Once you have seen a doctor and started treatment for your RSI, you will need to gather documentation about your injury and treatment plan. This documentation includes:

- Your medical records
- A list of medications prescribed by your doctor
- Documentation of any missed work days/reduced hours worked
- Documentation of any lost wages
- Documentation of any out-of-pocket expenses related to your injury/treatment (e.g., mileage driven to/from doctors' appointments).

This documentation will be important when pursuing workers' compensation benefits from your employer or their insurance company.

Submit a Claim to Your Employer



After gathering all relevant documentation about your RSI, you will need to submit it to your employer. Your employer is required by law to have workers' compensation insurance, and this is what will pay for your medical treatment and any lost wages you incur as a result of your RSI. Filing a claim is typically done by filling out a workers' compensation claim form and submitting it along with supporting documentation (e.g., medical records). Once received, the employer or insurance company has 14 days to respond to your claim form and request additional information, if needed. If they deny your claim, you have the right to appeal their decision.

If you have suffered an RSI at work, you may be entitled to workers' compensation benefits.
